What is a Special Leave Petition (SLP)?
A Special Leave Petition (SLP) is a constitutional remedy under Article 136 of the Indian Constitution, allowing any aggrieved party to approach the Supreme Court against the judgment or order of any court or tribunal in India. Though not a right, it is a discretionary power of the Supreme Court and is invoked only in cases involving substantial questions of law, gross injustice, or violation of fundamental rights.
When Can You File an SLP?
You may file an SLP when:
- A High Court has passed a judgment against you.
- Your appeal was dismissed in limine (at the preliminary stage).
- A tribunal or quasi-judicial body’s decision leads to injustice.
- A constitutional or significant legal question is involved.
Time Limit for Filing SLP:
- Within 90 days from the date of judgment/order.
- Within 60 days from the refusal of a certificate of appeal by the High Court.
